Full Text

218. Resisting the taking of property by the lawful authority of a public servant.—Whoever offers any resistance to the taking of any property by the lawful authority of any public servant, knowing or having reason to believe that he is such public servant, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to ten thousand rupees, or with both.

Plain English Summary

This section penalizes anyone who resists the lawful seizure or taking of property by a public servant, knowing the person is a public servant.

Key Legal Elements

  • Resistance offered to the taking of property
  • Taking is done by the lawful authority of a public servant
  • Accused knows or has reason to believe that the person is a public servant

Punishment

Imprisonment of either description up to 6 months, and/or fine up to ₹10,000.

Practical Note

The seizure must be backed by 'lawful authority'. If the public servant acts without lawful jurisdiction or with an invalid warrant, resistance might not constitute an offence under this section, though physically attacking them could still trigger other charges.
