Terrorist act.

(1) Whoever, with intent to threaten or likely to threaten the unity, integrity, sovereignty, security, or economic security of India or with intent to strike terror or likely to strike terror in the people or any section of the people in India or in any foreign country, commits any act using explosives, firearms, lethal weapons, poisonous or noxious gases or other chemicals or any other substance (whether biological radioactive, nuclear or otherwise) of a hazardous nature or by any other means of whatever nature to cause or likely to cause—\n(a) death of, or injuries to, any person or persons; or\n(b) damage to, or destruction of, property; or\n(c) disruption of any supplies or services essential to the life of the community in India or in any foreign country; or\n(d) damage to, or destruction of, any systems or councils used for critical infrastructure, or\n(e) damage to, or destruction of, any military or other public installations, or any facility for research, or any system or infrastructure for the economic security of India; or\n(f) damage to the monetary stability of India by way of production or smuggling or circulation of counterfeit Indian paper currency, coin or of any other material; or\n(g) detention of any person and threatening to kill or injure such person in order to compel the Government of India, any State Government or the Government of a foreign country or an international or inter-governmental organisation or any other person to do or abstain from doing any act; or\n(h) any other act which may be equivalent to or similar to the acts mentioned in clauses (a) to (g);\ncommits a terrorist act.\nPUNISHMENT: (i) If such act results in death of any person, be punished with death or imprisonment for life, and shall also be liable to fine; (ii) in any other case, be punished with imprisonment for a term which shall not be less than five years but which may extend to imprisonment for life, and shall also be liable to fine.

आतंकवादी कार्य।\n(1) जो कोई भारत की एकता, अखंडता, संप्रभुता, सुरक्षा या आर्थिक सुरक्षा को खतरे में डालने के इरादे से या खतरे में डालने की संभावना के साथ या भारत में या किसी विदेशी देश में लोगों या लोगों के किसी वर्ग में आतंक फैलाने के इरादे से या आतंक फैलाने की संभावना के साथ विस्फोटक, आग्नेयास्त्रों, घातक हथियारों, जहरीली या हानिकारक गैसों या अन्य रसायनों या किसी अन्य पदार्थ (चाहे जैविक रेडियोधर्मी, परमाणु या अन्यथा) का उपयोग करके कोई कार्य करता है या किसी अन्य माध्यम से जो कारित कर सकता है या जिसकी संभावना है—\n(क) किसी व्यक्ति या व्यक्तियों की मृत्यु या चोट; या\n(ख) संपत्ति की क्षति या विनाश; या\n(ग) भारत में या किसी विदेशी देश में समुदाय के जीवन के लिए आवश्यक किसी भी आपूर्ति या सेवाओं का व्यवधान; या\n(घ) महत्वपूर्ण बुनियादी ढांचे के लिए उपयोग की जाने वाली किसी भी प्रणाली या परिषदों की क्षति या विनाश, या\n(ङ) किसी भी सैन्य या अन्य सार्वजनिक प्रतिष्ठानों, या अनुसंधान के लिए किसी भी सुविधा, या भारत की आर्थिक सुरक्षा के लिए किसी भी प्रणाली या बुनियादी ढांचे की क्षति या विनाश; या\n(च) नकली भारतीय कागजी मुद्रा, सिक्के या किसी अन्य सामग्री के उत्पादन या तस्करी या संचलन के माध्यम से भारत की मौद्रिक स्थिरता को नुकसान; या\n(छ) किसी व्यक्ति को बंदी बनाना और ऐसे व्यक्ति को मारने या घायल करने की धमकी देना ताकि भारत सरकार, किसी राज्य सरकार या किसी विदेशी देश की सरकार या किसी अंतर्राष्ट्रीय या अंतर-सरकारी संगठन या किसी अन्य व्यक्ति को कोई कार्य करने या करने से परहेज करने के लिए मजबूर किया जा सके; या\n(ज) कोई अन्य कार्य जो खंड (क) से (छ) में उल्लिखित कार्यों के समकक्ष या समान हो सकता है;\nआतंकवादी कार्य करता है।\nदंड: (i) यदि ऐसे कार्य के परिणामस्वरूप किसी व्यक्ति की मृत्यु होती है, तो उसे मृत्युदंड या आजीवन कारावास से दंडित किया जाएगा, और वह जुर्माने के लिए भी उत्तरदायी होगा; (ii) किसी अन्य मामले में, कारावास से दंडित किया जाएगा जिसकी अवधि पांच वर्ष से कम नहीं होगी लेकिन जिसे आजीवन कारावास तक बढ़ाया जा सकता है, और वह जुर्माने के लिए भी उत्तरदायी होगा ।
