Act not in derogation of any other law

Full Text

The provisions of this Act shall be in addition to and not in derogation of the provisions of any other law for the time being in force and, in case of any inconsistency, the provisions of this Act shall have overriding effect on the provisions of any such law to the extent of the inconsistency.

Inserted by the 2019 Amendment. Multiple High Courts (Punjab & Haryana, Delhi, Karnataka) have ruled under Section 42A that the POCSO Act completely overrides personal laws; marrying a girl below 18 years under personal law provides no legal defence against prosecution under POCSO.

इस अधिनियम के उपबंध तत्समय प्रवृत्त किसी अन्य विधि के उपबंधों के अतिरिक्त होंगे न कि उनके अल्पीकरण में और किसी असंगति की दशा में, इस अधिनियम के उपबंध उस असंगति की सीमा तक ऐसी किसी विधि के उपबंधों पर अध्यारोही प्रभाव (ओवरराइडिंग प्रभाव) रखेंगे।
