Bank’s slip prima facie evidence of certain facts.—The Court shall, in respect of every proceeding under this Chapter, on production of Bank's slip or memo having thereon the official mark denoting that the cheque has been dishonoured, presume the fact of dishonour of such cheque, unless and until such fact is disproved.

ACCUSED'S BURDEN TO DISPROVE: • If the accused contends that the cheque was not presented or that funds were adequate, the burden lies on the accused to summon bank ledgers under the Bankers' Books Evidence Act, 1891 to rebut the presumption.

कतिपय तथ्यों का बैंक की पर्ची प्रथम दृष्टया साक्ष्य होना।—न्यायालय इस अध्याय के अधीन प्रत्येक कार्यवाही के संबंध में, बैंक की ऐसी पर्ची या ज्ञापन पेश किए जाने पर, जिस पर यह उपदर्शित करने वाला आधिकारिक चिह्न लगा हो कि चेक अनादृत हो गया है, ऐसे चेक के अनादर के तथ्य की उपधारणा करेगा, जब तक कि ऐसा तथ्य नासाबित न कर दिया जाए।
