Set of bills
Full Text
Set of bills.—Bills of exchange may be drawn in parts, each part being numbered and containing a provision that it shall continue payable only so long as the others remain unpaid. All the parts together make a set; but the whole set constitutes only one bill, and is extinguished when one of the parts, if a separate bill, would be extinguished.
Exception.—When a person accepts or indorses different parts of the bill in favour of different persons, he and the subsequent endorsers of each part are liable on such part as if it were a separate bill.
Plain English Summary
Allows bills of exchange to be drawn in numbered parts forming one single set, extinguishing upon payment of any one part, with an exception if separate parts are negotiated to different persons.
Key Legal Elements
- Bills of exchange may be drawn in numbered parts forming a set
- Each part conditions payment on the other parts remaining unpaid
- Payment of one part extinguishes the entire set
- Exception: Accepting or endorsing different parts to different persons creates separate liabilities
Practical Note
Widely used in international maritime trade (e.g. bills drawn in sets of three: First, Second, Third of Exchange). The parts are sent across different postal or courier channels to prevent loss at sea. The drawee must only accept and pay one part; if they accept multiple parts, they are liable on each under the statutory exception.
