Reasonable time of giving notice of dishonour
Full Text
Reasonable time of giving notice of dishonour.—If the holder and the party to whom notice of dishonour is given carry on business or live (as the case may be) in different places, such notice is given within a reasonable time if it is dispatched by the next post or on the day next after the day of dishonour.
If the said parties carry on business or live in the same place, such notice is given within a reasonable time if it is dispatched in time to reach its destination on the day next after the day of dishonour.
Plain English Summary
Defines the precise statutory timeframe for sending a dishonour notice based on whether the parties reside in different places or the same locality.
Key Legal Elements
- Different places: timely if dispatched by next post or on the day next after dishonour
- Same place: timely if dispatched in time to reach destination on the day next after dishonour
- Excludes non-business days and holidays pursuant to Section 105
Practical Note
Applies to civil actions on negotiable instruments. In contrast, criminal complaints under Section 138 NI Act provide an explicit, extended statutory period of 30 days from receipt of bank dishonour memo to dispatch the statutory demand notice, overriding this strict common law next-day requirement.
