When noting equivalent to protest

Full Text

When noting equivalent to protest.—For the purposes of this Act, where a bill or note is required to be protested within a specified time or before some further proceeding is taken it is sufficient that the bill has been noted for protest before the expiration of the specified time or the taking of the proceeding; and, the formal protest may be extended at any time thereafter as of the date of the noting.

Plain English Summary

Provides that timely noting of a bill by a notary satisfies any deadline for protest, allowing the formal protest certificate to be drawn up later.

Key Legal Elements

  • Applies where protest is required within a specified timeframe or before proceedings
  • Timely noting by a notary public is sufficient to satisfy statutory deadline
  • Formal protest certificate can be extended subsequently, relating back to noting date

Practical Note

A major practical convenience for litigants and notaries. As long as noting is initiated promptly upon dishonour, the formal drawing up and sealing of the elaborate protest instrument can be completed later without causing the claim to be barred by time.
