Punishment for contravention of certain other conditions for a Hindu marriage
Full Text
Every person who procures a marriage of himself or herself to be solemnized under this Act in contravention of the conditions specified in clauses (iii), (iv), and (v) of section 5 shall be punishable—
(a) in the case of contravention of the condition specified in clause (iii) of section 5, with rigorous imprisonment which may extend to two years or with fine which may extend to one lakh rupees, or with both;
(b) in the case of a contravention of the condition specified in clause (iv) or clause (v) of section 5, with simple imprisonment which may extend to one month, or with fine which may extend to one thousand rupees, or with both.

Practical Note
While marrying under legal age (Section 5(iii)) is punishable under 18(a) and under the Prohibition of Child Marriage Act, 2006, it is voidable under PCMA rather than void ab initio under HMA. Marrying within prohibited/sapinda degrees attracts Section 18(b) and renders the marriage void ab initio under Section 11.

प्रत्येक व्यक्ति, जो धारा 5 के खण्ड (iii), (iv) और (v) में विनिर्दिष्ट शर्तों के उल्लंघन में इस अधिनियम के अधीन अपना विवाह अनुष्ठापित करवाएगा, वह दंडनीय होगा—
(क) धारा 5 के खण्ड (iii) में विनिर्दिष्ट शर्त (आयु सीमा) के उल्लंघन की दशा में, कठिन कारावास से, जो दो वर्ष तक का हो सकेगा, या जुर्माने से, जो एक लाख रुपये तक का हो सकेगा, या दोनों से;
(ख) धारा 5 के खण्ड (iv) [प्रतिषिद्ध नातेदारी] या खण्ड (v) [सपिण्ड नातेदारी] में विनिर्दिष्ट शर्त के उल्लंघन की दशा में, सादा कारावास से, जो एक मास तक का हो सकेगा, या जुर्माने से, जो एक हजार रुपये तक का हो सकेगा, या दोनों से।
