Alternate relief in divorce proceedings

In any proceeding under this Act, on a petition for dissolution of marriage by a decree of divorce, except in so far as the petition is founded on the grounds mentioned in clauses (ii), (vi) and (vii) of sub-section (1) of section 13, the court may, if it considers it just so to do having regard to the circumstances of the case, pass instead a decree for judicial separation.

इस अधिनियम के अधीन किसी भी कार्यवाही में, विवाह-विच्छेद (तलाक) की डिक्री द्वारा विवाह के विघटन की अर्जी पर, सिवाय वहां के जहां तक कि अर्जी धारा 13 की उपधारा (1) के खण्ड (ii), (vi) और (vii) में उल्लिखित आधारों पर आधारित हो, न्यायालय मामले की परिस्थितियों को ध्यान में रखते हुए यदि ऐसा करना न्यायसंगत समझे, तो इसके स्थान पर न्यायिक पृथक्करण की डिक्री पारित कर सकेगा।
