Procedure in case of non-attendance of one or more of several plaintiffs

Full Text

Where there are more plaintiffs than one, and one or more of them appear, and the others do not appear, the Court may, at the instance of the plaintiff or plaintiffs appearing, permit the suit to proceed in the same way as if all the plaintiffs had appeared, or make such order as it thinks fit.

Plain English Summary

Permits the suit to proceed at the instance of appearing plaintiffs when one or more co-plaintiffs fail to appear on the hearing date.

Key Legal Elements

  • Multiple Plaintiffs: Protects diligent co-plaintiffs from being prejudiced by an absent co-plaintiff.
  • Court's Permission: Court permits the trial to proceed upon application or oral submission of appearing plaintiffs.
  • Discretionary Safeguards: Court can alternatively pass orders to transpose parties or issue notice to non-attending plaintiffs.

Practical Note

Practical Courtroom Submission: When co-plaintiffs fail to appear (e.g. partition suit between brothers where one brother is out of town), appearing plaintiff's counsel should orally move the court: 'Plaintiff No. 1 is present. Pray for permission under Order IX Rule 10 CPC to proceed with the suit on behalf of all plaintiffs'.
