Counter-claim to be stated
Full Text
Where any defendant seeks to rely upon any ground as supporting a right of counter-claim, he shall, in his written statement, state specifically that he does so by way of counter-claim.
Plain English Summary
Requires the defendant to specifically label and plead their cross-demand as a 'counter-claim' in the written statement.
Key Legal Elements
- Specific Pleading Formula: Must contain a distinct heading: 'Counter-Claim on behalf of Defendant'.
- Avoids Ambiguity with Set-off: Delineates counter-claim from defensive set-off.
- Triggers Registry Scrutiny: Alerts court registry to demand court fee and issue summons/notice to plaintiff.
Practical Note
Drafting Technique: In the Written Statement, after concluding the defense paragraphs, insert a bold heading: 'Counter-Claim under Order VIII Rule 6A CPC on behalf of Defendant against Plaintiff', followed by distinct paragraphs setting out cause of action, valuation, court fees, and prayer.
