Where the subject-matter of the suit is immovable property

Full Text

Where the subject-matter of the suit is immovable property, the plaint shall contain a description of the property sufficient to identify it, and, in case such property can be identified by boundaries or numbers in a record of settlement or survey, the plaint shall specify such boundaries or numbers.

Plain English Summary

Requires plaints concerning immovable property to provide precise and sufficient property descriptions, mandating demarcation by metes and bounds, municipal numbers, or settlement/khasra survey numbers.

Key Legal Elements

  • Sufficient Identification Standard: Decree must be capable of execution on the ground without ambiguity.
  • Metes and Bounds Requirement: North, South, East, West boundaries must be specifically demarcated.
  • Revenue & Settlement Records: Khasra, Khatauni, Survey numbers, or Municipal property assessment numbers must be specified.
  • Site Plan Annexure: Standard practice mandates annexing a red-edged site plan to the plaint.

Practical Note

Property Litigation Traps & Site Plans: 1. Execution Impossibility Precedent - Pratibha Singh v. Shanti Devi Prasad (2003) 2 SCC 330: Supreme Court held that where property is not identifiable by boundaries or survey numbers, no effective decree can be executed. A site plan showing exact dimensions and boundaries must be annexed to the plaint. 2. Defense Trap: If the plaintiff sues for possession or injunction over land without giving khasra numbers, boundaries, or a site plan, raise an objection under Order VII Rule 3. The suit is unexecutable and bad for vagueness. 3. Curing Defects: Under Section 152 CPC, errors in property boundaries in the decree can be corrected if the original revenue survey record is undisputed.
