Full Text
No pleading shall, except by way of amendment, raise any new ground of claim or contain any allegation of fact inconsistent with the previous pleadings of the party pleading the same.
Plain English Summary
Prohibits parties from departing from their original pleadings or introducing mutually destructive/inconsistent factual allegations, except through formal court-approved amendment.
Key Legal Elements
- Bar on Departure: Prohibits shifting the foundational stance taken in plaint or written statement.
- Inconsistent Pleadings Prohibited: Cannot plead facts destructive of the initial defense/claim in subsequent replications.
- Exclusive Route via Amendment: Alterations are permissible only through formal amendment under Order VI Rule 17.
Practical Note
Replication Traps: In filing a rejoinder or replication, plaintiffs often introduce totally new causes of action or contradictory facts. Defendant should object under Rule 7 that new claims cannot be smuggled in through replication without formal amendment.
