Person served to sign acknowledgment

Full Text

Where the serving officer delivers or tenders a copy of the summons to the defendant personally, or to an agent or other person on his behalf, he shall require the signature of the person to whom the copy is so delivered or tendered to an acknowledgment of service endorsed on the original summons.

Plain English Summary

Requires the process server delivering a summons to obtain the recipient's personal signature on the acknowledgment endorsed on the original court summons.

Key Legal Elements

  • Signature on Original: Recipient signs the endorsement on the reverse/annexure of original summons.
  • Evidentiary Link: Serves as primary documentary proof of receipt in court records.
  • Interplay with Rule 17: If the recipient refuses to sign, process server must proceed under Rule 17 (affixture).

Practical Note

Trial Practice: 1. Proof of Receipt: When verifying service, check the original summons in the court file. The signature of the defendant must match admitted signatures on vakalatnama or contracts; discrepancy provides strong ground to establish fraudulent service.
