Power to alter, etc., decree of Court making reference

Full Text

Where a case is referred to the High Court under rule 1 or under the proviso to section 113, the High Court may return the case for amendment, and may alter, cancel or set aside any decree or order which the Court making the reference has passed or made in the case out of which the reference arose, and make such order as it thinks fit.

Plain English Summary

Vests the High Court with wide supervisory powers on reference: returning the case for amendment of the statement, or altering, cancelling, or setting aside any contingent decree or order passed by the referring court, and making appropriate final orders.

Key Legal Elements

  • Return for Amendment: Remitting the reference back if statement of facts is incomplete or question improperly formulated.
  • Direct Alteration / Quashing of Decrees: High Court can directly alter, cancel, or set aside any contingent decree passed under Rule 2.
  • Applies to Both Streams: Governs references under Rule 1 as well as constitutional references under Section 113 proviso.

Practical Note

Remedial and Corrective Scope of Rule 5: 1. Curative Powers: If the reference statement drawn up under Rule 1 is sketchy or ignores vital pleadings, the High Court invokes Rule 5 to return the case to the referring judge for proper reformulation. 2. Avoiding Protracted Remands: If the subordinate judge has already passed a contingent decree under Rule 2, the High Court under Rule 5 can directly substitute the correct legal outcome or set aside the decree, saving parties from another cycle of subordinate hearings.
