Court may pass decree contingent upon decision of High Court
Full Text
The Court may either stay the proceedings or proceed in the case notwithstanding such reference, and may pass a decree or make an order contingent upon the decision of the High Court on the point referred:
But no decree or order shall be executed in any case in which such reference is made until the receipt of a copy of the judgment of the High Court upon the reference.
Plain English Summary
Allows the referring court either to stay the suit or proceed to trial and pass a contingent decree dependent on the High Court's reference ruling, but unconditionally bars execution until the High Court's judgment is received.
Key Legal Elements
- Discretionary Stay or Continuation: Court may halt proceedings pending reference or continue trial to completion.
- Contingent Decree: Court can deliver a judgment subject to the High Court's opinion on the legal point.
- Absolute Bar on Execution: No contingent decree or order can be put into execution until the High Court's opinion is received and integrated.
Practical Note
Strategic Use of Contingent Decrees Pending Reference: 1. Preventing Trial Paralysis: By allowing the court to proceed and pass a contingent decree, Rule 2 prevents trials from remaining stalled for years while the High Court answers the reference. Evidence is recorded while witnesses are available, and the final decree is drawn contingent upon the High Court's decision. 2. Automatic Protection Against Execution: The statutory prohibition in the second paragraph of Rule 2 is absolute. If a decree-holder attempts execution before the High Court transmits its decision, the executing court must stay all execution proceedings as a matter of law.
