Revocation of acceptance of security
Full Text
At any time before the admission of the appeal the Court may, upon cause shown, revoke the acceptance of any such security, and make further directions thereon.
Plain English Summary
Permits the High Court to revoke acceptance of security at any time before the appeal is admitted upon cause shown (such as insolvency of surety or defective title to secured property) and issue fresh directions.
Key Legal Elements
- Pre-Admission Power: Operates strictly before formal declaration of admission under Rule 8.
- Upon Cause Shown: Requires substantial ground (e.g. fraudulent surety, encumbered title, drastic depreciation).
- Further Directions: Court directs replacement with sound cash or solvent security within a specified timeframe.
Practical Note
Challenging Insolvent or Defective Sureties Before Admission: 1. Respondent's Remedy: If the appellant furnishes a property surety that is heavily encumbered or lacks marketable title, the respondent must promptly move an application under Rule 9 before the appeal is formally admitted under Rule 8. 2. Consequences of Revocation: If the court revokes acceptance and the appellant fails to substitute adequate security, the appeal proceedings are stayed under Rule 11.
