Security and deposit required on grant of certificate

(1) Where the certificate is granted, the applicant shall, within ninety days or such further period, not exceeding sixty days, as the Court may upon cause shown allow; from the date of the decree complained of, or within six weeks from the date of the grant of the certificate whichever is the later date,—

(a) furnish security in cash or in Government securities for the costs of the respondent, and

(b) deposit the amount required to defray the expense of translating, transcribing indexing printing, and transmitting to the Supreme Court a correct copy of the whole record of the suit, except—

(1) formal documents directed to be excluded by any Rule of the Supreme Court in force for the time being;

(2) papers which the parties agree to exclude;

(3) accounts, or portions of accounts, which the officer empowered by the Court for that purpose considers unnecessary, and which the parties have not specifically asked to be included; and

(4) such other documents as the High Court may direct to be excluded:

Provided that the Court at the time of granting the certificate may, after hearing any opposite party who appears, order on the ground of special hardship that some other form of security may be furnished:

Provided further, that no adjournment shall be granted to an opposite party to contest the nature of such security.

Modern Record Transmission: Under the current Supreme Court Rules, 2013, physical printing has largely been replaced by electronic transmission of digitized records, significantly reducing the quantum of deposit required under clause (b).

(1) जहां प्रमाणपत्र दे दिया जाता है, वहां आवेदक उस डिक्री की तारीख से जिसके विरुद्ध परिवाद है, नब्बे दिन के भीतर या ऐसी अतिरिक्त कालावधि के भीतर जो साठ दिन से अधिक न हो जैसी न्यायालय हेतुक दर्शित किए जाने पर अनुज्ञात करे, अथवा प्रमाणपत्र दिए जाने की तारीख से छह सप्ताह के भीतर, इनमें से जो भी तारीख बाद की हो,—

(क) प्रत्यर्थी के खर्चों के लिए नकद या सरकारी प्रतिभूतियों में प्रतिभूति देगा, तथा

(ख) वाद के संपूर्ण अभिलेख की एक सही प्रति का अनुवाद कराने, प्रतिलेखन, अनुक्रमणिका बनाने, मुद्रण कराने और उच्चतम न्यायालय को पारेषित करने के व्यय को पूरा करने के लिए अपेक्षित राशि जमा करेगा, सिवाय—

(1) ऐसे औपचारिक दस्तावेजों के जिन्हें उस समय प्रवृत्त उच्चतम न्यायालय के किसी नियम द्वारा अपवर्जित करने का निदेश दिया गया हो;

(2) ऐसे कागजातों के जिन्हें अपवर्जित करने के लिए पक्षकार सहमत हों;

(3) ऐसे लेखाओं या लेखाओं के भागों के जिन्हें इस प्रयोजन के लिए न्यायालय द्वारा सशक्त अधिकारी अनावश्यक समझता है और जिन्हें पक्षकारों ने विशेष रूप से सम्मिलित करने की मांग नहीं की है; तथा

(4) ऐसे अन्य दस्तावेजों के जिन्हें उच्च न्यायालय अपवर्जित करने का निदेश दे:

परंतु न्यायालय प्रमाणपत्र देते समय, उपसंजात होने वाले किसी विरोधी पक्षकार को सुनने के पश्चात, विशेष कठिनाई के आधार पर यह आदेश दे सकेगा कि किसी अन्य प्रकार की प्रतिभूति दी जाए:

परंतु यह और कि ऐसी प्रतिभूति की प्रकृति का विरोध करने के लिए विरोधी पक्षकार को कोई स्थगन (Adjournment) नहीं दिया जाएगा।
