Appeal from order relating to execution

Full Text

The orders made by the Court which executes the decree or order of the Supreme Court, relating to such execution, shall be appealable in the same manner and subject to the same rules as the orders of such Court relating to the execution of its own decrees.

Plain English Summary

Provides that orders passed by the trial court in executing a Supreme Court decree are appealable in the same manner and subject to the same rules as orders executing its own decrees under the Code.

Key Legal Elements

  • Parity with Domestic Execution Orders: Execution orders treated identically to trial court's own execution proceedings.
  • Governed by Section 47 & Order XXI: Appealability determined by CPC provisions on execution (e.g. Order 43 Rule 1(j), (ja) or revisions).
  • Appellate Forum: Appeals lie to the District Court or High Court as per standard valuation and forum rules.

Practical Note

Appellate Remedies in Supreme Court Executions: 1. Execution Objections and Appeals: When executing a Supreme Court decree under Rule 15, if the execution court passes an order on an objection (e.g. under Order XXI Rule 58, Rule 92, or Rule 106), that order is subject to the ordinary appellate hierarchy under Rule 16. 2. Limits on Executing Court: The executing court cannot go behind the Supreme Court's decree or modify its terms; any order attempting to vary the Supreme Court's verdict is ultra vires and appealable.
