Effect of failure to comply with order

Full Text

Where the appellant fails to comply with such order, the proceedings shall be stayed, and the appeal shall not proceed without an order in this behalf of the Supreme Court, and in the meantime execution of the decree appealed from shall not be stayed.

Plain English Summary

Specifies sanctions for failure to furnish additional security or payment under Rule 10: appeal proceedings in the High Court are stayed, appeal cannot proceed without an order from the Supreme Court, and execution of the decree proceeds unhindered.

Key Legal Elements

  • Automatic Stay of Appeal: Appeal proceedings are stalled at the High Court stage.
  • Supreme Court Order Required: Matter cannot be revived without an express order of the Supreme Court.
  • No Stay of Execution: Decree-holder is completely free to execute the decree without impediment.

Practical Note

Severe Consequences of Non-Deposit under Rule 11: 1. Complete Exposure to Execution: Rule 11 creates a dual penalty: the appeal is frozen, and any stay of execution obtained by the appellant lapses automatically. The decree-holder can immediately enforce the decree in the execution court. 2. Revival Only in Supreme Court: Once Rule 11 is triggered, the High Court loses jurisdiction to condone the delay or accept belated payment; the appellant must approach the Supreme Court directly for directions.
