Section O44R2Procedural

Grant of time for payment of court-fee

Full Text

Where an application is rejected under rule 1, the Court may, while rejecting the application, allow the applicant to pay the requisite Court-fee, within such time as may be fixed by the Court or extended by it from time to time; and upon such payment, the memorandum of appeal in respect of which such fee is payable shall have the same force and effect as if such fee had been paid in the first instance.

Plain English Summary

Empowers the appellate court upon rejecting an application for leave to appeal as an indigent person to grant time to pay the requisite court fees; upon payment, the memorandum of appeal relates back to its original presentation date, protecting limitation.

Key Legal Elements

  • Inserted by 1976 Amendment: Codifies Section 149 CPC principles explicitly for indigent appeals.
  • Discretionary Time Granted: Court allows reasonable time to deposit deficit court fee upon rejecting indigent status.
  • Doctrine of Relation Back: Upon payment within the fixed or extended time, the appeal is treated as filed on the original date of presentation.
  • Protection Against Limitation: Prevents dismissal of the appeal on limitation grounds due to time spent in the indigency inquiry.

Practical Note

Relation Back & Protection of Limitation under Rule 2: 1. Statutory Invocation of Section 149: Rule 2 is a specific legislative application of Section 149 CPC. If the court finds that the appellant is not indigent (e.g. holds sufficient disposable property), it cannot dismiss the appeal simultaneously. Counsel must promptly seek time under Rule 2 to pay the court fee. Once the court fee is deposited within the time granted, the memorandum of appeal becomes effective from the date of its original presentation, overriding any intervening expiry of limitation (Jugalkishore v. Sitabai, AIR 1968 Bom 383). 2. Extension of Time: The court possesses inherent jurisdiction to extend time from time to time under Rule 2 read with Section 148 CPC upon sufficient cause shown.
