Appeal from orders

Full Text

An appeal shall lie from the following orders under the provisions of section 104, namely: —

(a) an order under rule 10 of Order VII returning a plaint to be presented to the proper Court except where the procedure specified in rule 10A of Order VII has been followed;

(c) an order under rule 9 of Order IX rejecting an application (in a case open to appeal) for an order to set aside the dismissal of a suit;

(d) an order under rule 13 of Order IX rejecting an application (in a case open to appeal) for an order to set aside a decree passed ex parte;

(f) an order under rule 21 of Order XI;

(i) an order under rule 34 of Order XXI on an objection to the draft of a document or of an endorsement;

(j) an order under rule 72 or rule 92 of Order XXI setting aside or refusing to set aside a sale;

(ja) an order rejecting an application made under sub-rule (1) of rule 106 of Order XXI, provided that an order on the original application, that is to say, the application referred to in sub-rule (1) of rule 105 of that Order is appealable;

(k) an order under rule 9 of Order XXII refusing to set aside the abatement or dismissal of a suit;

(l) an order under rule 10 of Order XXII giving or refusing to give leave;

(n) an order under rule 2 of Order XXV rejecting an application (in a case open to appeal) for an order to set aside the dismissal of a suit;

(na) an order under rule 5 or rule 7 of Order XXXIII rejecting an application for permission to sue as an indigent person;

(p) orders in interpleader-suits under rule 3, rule 4 or rule 6 of Order XXXV;

(q) an order under rule 2, rule 3 or rule 6 of Order XXXVIII;

(r) an order under rule 1, rule 2, rule 2A, rule 4 or rule 10 of Order XXXIX;

(s) an order under rule 1, or rule 4 of Order XL;

(t) an order of refusal under rule 19 of Order XLI to re-admit, or under rule 21 of Order XLI to re-hear, an appeal;

(u) an order under rule 23 or rule 23A of Order XLI remanding a case, where an appeal would lie from the decree of the Appellate Court;

(w) an order under rule 4 of Order XLVII granting an application for review.

Practical Note

Strategic Litigation under Order XLIII Rule 1 (FAOs): 1. The Asymmetry of Clauses (c) and (d): Under clauses (c) and (d), an appeal lies ONLY when the trial court REJECTS an application to set aside dismissal for default (O9R9) or an ex-parte decree (O9R13). If the trial court ALLOWS the application and restores the suit or sets aside the ex-parte decree, NO appeal lies under this rule; the aggrieved plaintiff can only challenge that restoration by filing a Civil Revision under Section 115 CPC or a petition under Article 227 (Bhanu Kumar Jain v. Archana Kumar, 2005 1 SCC 787). 2. Temporary Injunction Appeals & Appellate Restraint: In Wander Ltd. v. Antox India P. Ltd. (1990 Supp SCC 727) and Mohd. Mehtab Khan v. Khushnuma Ibrahim Khan (2013) 9 SCC 221, the Supreme Court established that the appellate court in an appeal under Order 43 Rule 1(r) should not interfere with the discretion of the trial court regarding temporary injunctions unless the discretion has been shown to have been exercised arbitrarily, capriciously, or in ignorance of settled legal principles. 3. Bar of Second Appeal (Section 104(2)): Any order passed by the District Court in an appeal under Order 43 Rule 1 cannot be subjected to a second appeal in the High Court. The only avenue of challenge is supervisory jurisdiction under Article 227 of the Constitution.

धारा 104 के उपबंधों के अधीन निम्नलिखित आदेशों की अपील होगी, अर्थात्:—

(क) आदेश 7 के नियम 10 के अधीन वादपत्र को समुचित न्यायालय में प्रस्तुत किए जाने हेतु लौटाने का आदेश, सिवाय वहां जहां आदेश 7 के नियम 10क में विनिर्दिष्ट प्रक्रिया का अनुसरण किया गया है;

(ग) आदेश 9 के नियम 9 के अधीन वाद के खारिज किए जाने को अपास्त करने के आदेश के लिए किसी आवेदन को (ऐसे मामले में जिसमें अपील हो सकती है) नामंजूर करने का आदेश;

(घ) आदेश 9 के नियम 13 के अधीन एकपक्षीय पारित डिक्री को अपास्त करने के आदेश के लिए किसी आवेदन को (ऐसे मामले में जिसमें अपील हो सकती है) नामंजूर करने का आदेश;

(च) आदेश 11 के नियम 21 के अधीन कोई आदेश;

(झ) आदेश 21 के नियम 34 के अधीन किसी दस्तावेज या पृष्ठांकन के प्रारूप पर किसी आक्षेप पर दिया गया आदेश;

(ञ) आदेश 21 के नियम 72 या नियम 92 के अधीन किसी विक्रय को अपास्त करने या अपास्त करने से इंकार करने का आदेश;

(ञक) आदेश 21 के नियम 106 के उप-नियम (1) के अधीन किए गए आवेदन को नामंजूर करने वाला आदेश, बशर्ते कि मूल आवेदन पर, अर्थात् उस आदेश के नियम 105 के उप-नियम (1) में निर्दिष्ट आवेदन पर आदेश अपीलनीय हो;

(ट) आदेश 22 के नियम 9 के अधीन वाद के उपशमन (Abatement) या खारिज किए जाने को अपास्त करने से इंकार करने वाला आदेश;

(ठ) आदेश 22 के नियम 10 के अधीन इजाजत देने या देने से इंकार करने वाला आदेश;

(ढ) आदेश 25 के नियम 2 के अधीन वाद के खारिज किए जाने को अपास्त करने के आदेश के आवेदन को (ऐसे मामले में जिसमें अपील हो सकती है) नामंजूर करने वाला आदेश;

(ढक) आदेश 33 के नियम 5 या नियम 7 के अधीन निर्धन व्यक्ति के रूप में वाद लाने की अनुज्ञा के आवेदन को नामंजूर करने वाला आदेश;

(त) आदेश 35 के नियम 3, नियम 4 या नियम 6 के अधीन अंतराभिवाची वादों (Interpleader-suits) में आदेश;

(थ) आदेश 38 के नियम 2, नियम 3 या नियम 6 के अधीन कोई आदेश;

(द) आदेश 39 के नियम 1, नियम 2, नियम 2क, नियम 4 या नियम 10 के अधीन कोई आदेश;

(ध) आदेश 40 के नियम 1 या नियम 4 के अधीन कोई आदेश;

(न) आदेश 41 के नियम 19 के अधीन अपील को पुनः ग्रहण करने से, अथवा आदेश 41 के नियम 21 के अधीन अपील की पुनः सुनवाई करने से इंकार करने का आदेश;

(प) आदेश 41 के नियम 23 या नियम 23क के अधीन मामले को प्रतिप्रेषित (Remand) करने का आदेश, जहां अपीलीय न्यायालय की डिक्री से अपील हो सकती हो;

(ब) आदेश 47 के नियम 4 के अधीन पुनर्विलोकन (Review) के आवेदन को मंजूर करने वाला आदेश।
