(1) An appeal shall not operate as a stay of proceedings under a decree or order appealed from except so far as the Appellate Court may order, nor shall execution of a decree be stayed by reason only of an appeal having been preferred from the decree; but the Appellate Court may for sufficient cause order stay of execution of such decree.
Explanation.—An order by the Appellate Court for the stay of execution of the decree shall be effective from the date of the communication of such order to the Court of first instance, but an affidavit sworn by the appellant, based on his personal knowledge, stating that an order for the stay of execution of the decree has been made by the Appellate Court shall, pending the receipt from the Appellate Court of the order for the stay of execution or any order to the contrary, be acted upon by the Court of first instance.
(2) Stay by Court which passed the decree.—Where an application is made for stay of execution of an appealable decree before the expiration of the time allowed for appealing therefrom, the Court which passed the decree may on sufficient cause being shown order the execution to be stayed.
(3) No order for stay of execution shall be made under sub-rule (1) or sub-rule (2) unless the Court making it is satisfied—
(a) that substantial loss may result to the party applying for stay of execution unless the order is made;
(b) that the application has been made without unreasonable delay; and
(c) that security has been given by the applicant for the due performance of such decree or order as may ultimately be binding upon him.
(4) Subject to the provision of sub-rule (3), the Court may make an ex parte order for stay of execution pending the hearing of the application.
(5) Notwithstanding anything contained in the foregoing sub-rules, where the appellant fails to make the deposit or furnish the security specified in sub-rule (3) of rule 1, the Court shall not make an order staying the execution of the decree.

(1) उस डिक्री या आदेश के अधीन कार्यवाहियों पर जिसके विरुद्ध अपील की गई है, अपील किए जाने मात्र से कोई रोक (Stay) नहीं लगेगी, सिवाय वहां तक जहां तक कि अपीलीय न्यायालय आदेश दे, और न ही डिक्री से केवल अपील दायर किए जाने के कारण डिक्री का निष्पादन रुकेगा; किंतु अपीलीय न्यायालय पर्याप्त हेतुक होने पर ऐसी डिक्री के निष्पादन पर रोक लगाने का आदेश दे सकेगा।
स्पष्टीकरण—डिक्री के निष्पादन के स्थगन के लिए अपीलीय न्यायालय का आदेश प्रथम दृष्टया न्यायालय को ऐसे आदेश की संसूचना (Communication) की तारीख से प्रभावी होगा, किंतु अपीलार्थी द्वारा अपनी व्यक्तिगत जानकारी पर आधारित एक शपथपत्र, जिसमें यह प्रकथन किया गया हो कि अपीलीय न्यायालय द्वारा डिक्री के निष्पादन के स्थगन का आदेश दिया गया है, अपीलीय न्यायालय से स्थगन आदेश या इसके विपरीत आदेश प्राप्त होने तक, प्रथम दृष्टया न्यायालय द्वारा उस पर कार्यवाही की जाएगी।
(2) डिक्री पारित करने वाले न्यायालय द्वारा स्थगन—जहां किसी अपील योग्य डिक्री के निष्पादन के स्थगन के लिए आवेदन अपील करने के लिए अनुज्ञात समय की समाप्ति से पूर्व किया जाता है, वहां वह न्यायालय जिसने डिक्री पारित की थी, पर्याप्त हेतुक दर्शित किए जाने पर निष्पादन को रोके जाने का आदेश दे सकेगा।
(3) उप-नियम (1) या उप-नियम (2) के अधीन निष्पादन के स्थगन का कोई आदेश तब तक नहीं किया जाएगा जब तक कि ऐसा आदेश करने वाले न्यायालय का यह समाधान न हो जाए—
(क) कि यदि आदेश न किया गया तो निष्पादन के स्थगन के लिए आवेदन करने वाले पक्षकार को सारभूत हानि (Substantial loss) हो सकती है;
(ख) कि आवेदन अयुक्तियुक्त विलंब के बिना किया गया है; तथा
(ग) कि आवेदक द्वारा ऐसी डिक्री या आदेश के सम्यक पालन के लिए प्रतिभूति दे दी गई है जो अंततः उस पर आबद्धकर हो।
(4) उप-नियम (3) के उपबंधों के अधीन रहते हुए, न्यायालय आवेदन की सुनवाई लंबित रहने तक निष्पादन के स्थगन का एकपक्षीय आदेश कर सकेगा।
(5) पूर्वगामी उप-नियमों में किसी बात के होते हुए भी, जहां अपीलार्थी नियम 1 के उप-नियम (3) में विनिर्दिष्ट निक्षेप (Deposit) करने या प्रतिभूति देने में विफल रहता है, वहां न्यायालय डिक्री के निष्पादन पर रोक लगाने का कोई आदेश नहीं करेगा।
