Plain English Summary
Specifies formal requirements of an appellate decree: bearing date of judgment pronouncement, full particulars of parties, clear specification of relief and costs, signature of concurring judges, and dispensing with signature of a dissenting judge.
Key Legal Elements
- Date Corresponds to Judgment Date: Bear the date of open court judgment pronouncement.
- Specification of Relief: Clear, executable terms specifying rights and duties declared or mandated.
- Itemized Costs (Sub-rule 3): Court fees, pleader's fees, and out-of-pocket costs with liability apportioned.
- Signatures (Sub-rule 4): Signed by concurring judges; dissenting judge need not sign.
Practical Note
Drawing Up of Appellate Decrees and Correction of Errors: 1. Essential for Execution: An execution petition cannot proceed on the judgment alone; an executable decree under Rule 35 is required. Counsel must ensure that the appellate registry draws up the decree promptly and that the operative relief in the decree conforms exactly with the judgment. 2. Discrepancy Between Judgment and Decree: If the decree omits any relief granted in the judgment or errs in costs calculation, an application for amendment of decree under Section 152 read with Section 151 CPC must be filed before the appellate court.
