Full Text
Where the Court from whose decree an appeal is preferred has disposed of the suit upon a preliminary point and the decree is reversed in appeal, the Appellate Court may, if it thinks fit, by order remand the case, and may further direct what issue or issues shall be tried in the case so remanded, and shall send a copy of its judgment and order to the Court from whose decree the appeal is preferred, which directions to re-admit the suit under its original number in the register of civil suits, and proceed to determine the suit; and the evidence (if any) recorded during the original trial shall, subject to all just exceptions, be evidence during the trial after remand.
Plain English Summary
Authorizes the appellate court to remand a suit disposed of by the trial court on a preliminary point upon reversing that decree, directing re-admission under its original number and trial on specified remaining issues.
Key Legal Elements
- Disposal on Preliminary Point: Trial court decided suit on a threshold legal issue (e.g. limitation, jurisdiction, res judicata, court fees) without deciding merits.
- Reversal by Appellate Court: The preliminary finding is reversed in appeal.
- Discretionary Remand: Appellate court may remand and specify issues to be tried on remand.
- Re-admission Under Original Number: Suit restored in register of civil suits of trial court.
- Continuity of Existing Evidence: Prior evidence recorded remains valid during post-remand trial.
- Appealable Order: An order under Rule 23 is appealable under Order XLIII Rule 1(u) CPC.
Practical Note
Preliminary Point Remands & Appealability: 1. Definition of 'Preliminary Point': A preliminary point is one that is collateral to the merits of the dispute which, if decided against the plaintiff, precludes trial on the substantive causes of action (e.g. barred by limitation, res judicata, lack of pecuniary/territorial jurisdiction, lack of statutory notice under Section 80 CPC). 2. Appealable under Order 43 Rule 1(u): In Jegannathan v. Raju Sigamani (2012) 5 SCC 540 and P. Purushottam Reddy v. Pratap Steels Ltd. (2002) 2 SCC 686, the Supreme Court held that an order of remand under Rule 23 or Rule 23A is specifically appealable under Order 43 Rule 1(u) to the High Court, provided that an appeal would lie against the final decree of the appellate court (i.e. satisfying Section 100 substantial question of law criteria).
