Re-admission of appeal dismissed for default
Full Text
Where an appeal is dismissed under rule 11, sub-rule (2) or rule 17, the appellant may apply to the Appellate Court for the re-admission of the appeal; and, where it is proved that he was prevented by any sufficient cause from appearing when the appeal was called on for hearing or from depositing the sum so required, the Court shall re-admit the appeal on such terms as to costs or otherwise as it thinks fit.
Plain English Summary
Enables the appellant whose appeal was dismissed for default under Rule 11(2) or Rule 17 to apply for re-admission/restoration upon demonstrating 'sufficient cause' preventing appearance, with mandatory re-admission upon such proof.
Key Legal Elements
- Restoration of Default Dismissal: Primary remedy for appeals dismissed under Rule 11(2) or Rule 17.
- Sufficient Cause Test: Illness, sudden accident, counsel held up in another court, bereavement.
- Mandatory Language: Court 'shall' re-admit the appeal upon proof of sufficient cause.
- Limitation: 30 days from date of dismissal under Article 122 of the Limitation Act, 1963.
- Conditional Terms: Re-admission may be conditioned upon paying costs to the respondent.
Practical Note
Liberal Approach in Restoring Appeals: 1. Substantive Justice Over Technicality: In Collector, Land Acquisition v. Katiji (1987) 2 SCC 107 and Rafiq v. Munshilal (1981) 2 SCC 788, the Supreme Court emphasized that an innocent litigant should not suffer for the default or lapse of his advocate. Where counsel was engaged elsewhere or failed to note the cause list, courts take a liberal view under Rule 19 to restore the appeal on payment of reasonable costs. 2. Article 122 Limitation: An application under Rule 19 must be filed within 30 days from the date of dismissal; delay beyond 30 days requires an application under Section 5 Limitation Act.
