Section O41R16Procedural

Right to begin

Full Text

(1) On the day fixed, or on any other day to which the hearing may be adjourned, the appellant shall be heard in support of the appeal.

(2) The Court shall then, if it does not dismiss the appeal at once, hear the respondent against the appeal, and in such case the appellant shall be entitled to reply.

Plain English Summary

Regulates the order of oral arguments in appeal hearings: appellant begins, respondent argues in opposition, and appellant exercises the right of rejoinder/reply.

Key Legal Elements

  • Appellant Begins: Obligation to open the case and demonstrate errors in the impugned decree.
  • Respondent Opposition: Called upon only if appellate court finds prima facie merit.
  • Appellant's Right of Reply: Entitled to rejoinder on points raised by respondent.

Practical Note

Appellate Argument Sequence: The appellant must marshal facts and law from the certified trial record to displace the findings of the trial court. If the court is not persuaded by the appellant, it can dismiss the appeal without calling upon the respondent to argue.
