Enforcement of receiver’s duties
Full Text
Where a receiver—
(a) fails to submit his accounts at such periods and in such form as the Court directs, or
(b) fails to pay amount due from him as the Court directs, or
(c) occasions loss to the property by his wilful default or gross negligence,
the Court may direct his property to be attached and may sell such property, and may apply the proceeds to make good any amount found to be due from him or any loss occasioned by him, and shall pay the balance (if any) to the receiver.
Plain English Summary
Provides summary coercive enforcement against a defaulting receiver: attachment and public sale of his personal property to make good unpaid balances or financial losses caused by his wilful default or gross negligence.
Key Legal Elements
- Summary Coercive Power: Court enforces receiver's liability directly without relegating the parties to an independent recovery suit.
- Three Triggering Defaults: (a) Failure to file accounts, (b) Non-payment of balances, (c) Causing loss by wilful default/gross negligence.
- Attachment & Auction of Personal Assets: Court issues attachment and sale of receiver's personal properties under execution provisions.
- Restitution of Surplus: Net proceeds applied to discharge the deficiency, and remaining residue returned to receiver.
- Appealability under Order XLIII Rule 1(s): An order under Rule 4 is an appealable order.
Practical Note
Summary Recovery Against Defaulting Receivers: 1. Direct In-House Realization: Rule 4 provides a complete code for holding court officers accountable. If an inquiry reveals that the receiver siphoned off rental proceeds or caused damage to the property through gross dereliction of duty, the court calculates the surcharge and immediately attaches his personal properties without driving the parties to a separate civil suit. 2. Appealable Order: An order passed under Rule 4 directing attachment or sale of the receiver's property is expressly appealable under Order XLIII Rule 1(s) CPC.
