Application for such orders to be after notice

Full Text

(1) An application by the plaintiff for an order under rule 6 or rule 7 may be made at any time after institution of the suit.

(2) An application by the defendant for a like order may be made at any time after appearance.

(3) Before making an order under rule 6 or rule 7 on an application made for the purpose, the Court shall, except where it appears that the object of making such order would be defeated by the delay, direct notice thereof to be given to the opposite party.

Plain English Summary

Regulates the timing and notice requirements for interim sale or inspection orders under Rules 6 and 7: plaintiff can apply after institution, defendant after appearance, with prior notice mandatory unless delay would defeat the object.

Key Legal Elements

  • Plaintiff's Locus: Immediately upon filing of the plaint.
  • Defendant's Locus: Only after entering appearance in the suit.
  • Mandatory Notice (Sub-rule 3): Prior notice to opposite party is obligatory as a rule of natural justice.
  • Ex Parte Exception: Notice dispensed with only when delay would defeat the very purpose of the inspection/sale.

Practical Note

Timing and Dispensation of Notice: 1. Plaintiff vs Defendant Timing: While a plaintiff can apply for an urgent preservation order on Day 1 along with the plaint, a defendant must first enter appearance before invoking Rule 6 or Rule 7. 2. Ex Parte Inspection: Under Sub-rule (3), the court can dispense with notice for Rule 7 inspection where giving advance notice would prompt the defendant to tamper with the evidence, remove the counterfeit goods, or demolish the unauthorized construction before the commissioner arrives.
