Power to order interim sale
Full Text
The Court may, on the application of any party to a suit, order the sale, by any person named in such order, and in such manner and on such terms as it thinks fit, of any movable property, being the subject-matter of such suit, or attached before judgment in such suit, which is subject to speedy and natural decay, or which for any other just and sufficient cause, it may be desirable to have sold at once.
Plain English Summary
Empowers the court upon application to order the immediate interim auction or sale of movable suit property or pre-judgment attached assets that are perishable, subject to rapid decay, or where immediate sale is just.
Key Legal Elements
- Perishable Movables: Agricultural crops, fruits, vegetables, livestock, chemicals, or pharmaceuticals nearing expiry.
- Other Just & Sufficient Cause: Heavy warehouse storage charges exceeding property value, volatile market goods.
- Covers Attached Assets: Applies to movables attached before judgment under Order XXXVIII Rule 5.
- Sale Proceeds Deposited in Court: The sale proceeds take the place of the movable property and are held in court deposit pending final decree.
Practical Note
Preservation of Value Through Interim Liquidation: 1. Perishable Goods & Depreciating Assets: In commercial disputes involving perishable consumables or livestock, keeping the goods in warehouse custody pending a multi-year trial destroys their entire commercial value. Rule 6 allows the court to appoint a receiver or court commissioner to auction the goods immediately at market value. 2. Conversion into Cash Fund: The net sale proceeds are deposited into a high-yielding fixed deposit account in court, preserving the subject-matter intact for the winning party without financial deterioration.
