Court to dispose of application for injunction within thirty days
Full Text
Where an injunction has been granted without giving notice to the opposite party, the Court shall make an endeavour to finally dispose of the application within thirty days from the date on which the injunction was granted; and where it is unable so to do, it shall record its reasons for such inability.
Plain English Summary
Directs the court to make an earnest endeavour to finally dispose of an ex parte ad interim injunction application within thirty days of grant, requiring recorded reasons if unable to do so.
Key Legal Elements
- Thirty-Day Target: Statutory benchmark to prevent prolonged ex parte orders strangling the opposite party.
- Mandatory Recording of Reasons for Inability: Trial judge must explicitly record on the ordersheet why the matter could not be decided within 30 days.
- Remedy of Appeal if Not Decided: Aggrieved party can file an appeal under Order XLIII Rule 1(r) against the de facto continuation of the ex parte order.
- Inserted by 1976 Amendment: Curbing the menace of indefinitely lingering ex parte injunctions.
Practical Note
Right of Appeal When 30-Day Window Exceeded: 1. Supreme Court Ruling in A. Venkatasubbiah Naidu (2000) 7 SCC 695: The Supreme Court held that while the period of 30 days is directory and the ex parte order does not automatically lapse on the 31st day, if the trial court fails to dispose of the injunction application within 30 days and grants repeated adjournments without recording reasons, the aggrieved defendant is not helpless. He can treat the prolonged continuation as an appealable order refusing to vacate and file an appeal under Order XLIII Rule 1(r) CPC before the District Judge or High Court. 2. Practice Tip: Defense counsel should file an urgent application drawing attention to Rule 3A and request day-to-day hearing.
