Injunction to restrain repetition or continuance of breach

Full Text

(1) In any suit for restraining the defendant from committing a breach of contract or other injury of any kind, whether compensation is claimed in the suit or not, the plaintiff may, at any time after the commencement of the suit, and either before or after judgment, apply to the Court for a temporary injunction to restrain the defendant from committing the breach of contract or injury complained of, or any breach of contract or injury of a like kind arising out of the same contract or relating to the same property or right.

(2) The Court may by order grant such injunction, on such terms as to the duration of the injunction, keeping an account, giving security, or otherwise, as the Court thinks fit.

Plain English Summary

Authorizes temporary injunctions to restrain the repetition or continuance of a breach of contract, tortious injury, trademark/patent infringement, or nuisance, empowering the court to impose protective terms such as keeping accounts or furnishing security.

Key Legal Elements

  • Breach of Contract & Civil Wrongs: Restrains continuing or threatened breaches of contractual covenants or tortious wrongs.
  • Intellectual Property & Commercial Suits: Primary procedural vehicle for interim injunctions in trademark passing-off, patent, and copyright infringement.
  • Whether Compensation Claimed or Not: Availability of damages does not automatically disentitle plaintiff if the injury is recurring.
  • Conditional Injunctions (Sub-rule 2): Court can impose terms: maintaining sales accounts, furnishing bank guarantees, or limiting duration.
  • Negative Covenants: Enforces negative stipulations under Section 42 of the Specific Relief Act, 1963.

Practical Note

Application in Commercial Contracts & Intellectual Property: 1. Negative Covenants in Contracts: Under Section 42 of the Specific Relief Act, 1963 read with Order XXXIX Rule 2, where a contract contains an express negative covenant not to perform a particular act, the court can grant an interim injunction to restrain breach of the negative covenant even if specific performance of the affirmative agreement cannot be enforced. 2. Protective Accounting Mechanism: Under Sub-rule (2), where an absolute injunction might cripple a going commercial business, courts frequently balance equities by permitting the defendant to manufacture/trade subject to maintaining audited accounts of all sales and furnishing quarterly affidavits in court.
