Attachment where cause not shown or security not furnished
Full Text
(1) Where the defendant fails to show cause why he should not furnish security, or fails to furnish the security required, within the time fixed by the Court, the Court may order that the property specified, or such portion thereof as appears sufficient to satisfy any decree which may be passed in the suit, be attached.
(2) Where the defendant shows such cause or furnishes the required security, and the property specified or any portion of it has been attached, the Court shall order the attachment to be withdrawn, or make such other order as it thinks fit.
Plain English Summary
Provides for the formal attachment of the specified property if the defendant defaults in showing cause or furnishing security under Rule 5, and mandates withdrawal of attachment upon compliance or cause shown.
Key Legal Elements
- Consequence of Default: Absolute power to attach specified assets upon failure to furnish security.
- Attachment of 'Sufficient Portion': Restricts attachment only to so much property as suffices to satisfy the anticipated decree.
- Mandatory Withdrawal (Sub-rule 2): Court 'shall' withdraw conditional attachment the moment cause is shown or security is furnished.
- Appealability under Order XLIII Rule 1(q): An order under Rule 6 is an appealable order.
Practical Note
Appellate Remedy & Duty of Proportionality: 1. Appealable Order: An order passed under Rule 6(1) directing attachment, as well as an order under Rule 6(2) withdrawing or refusing to withdraw attachment, is expressly appealable under Order XLIII Rule 1(q) CPC. 2. Proportional Attachment: The court has no jurisdiction to attach property worth crores when the suit claim is only for a few lakhs. Sub-rule (1) strictly limits attachment to 'such portion thereof as appears sufficient to satisfy any decree'.
