Full Text

(1) A surety for the appearance of a defendant may at any time apply to the Court in which he became such surety to be discharged from his obligation.

(2) On such application being made, the Court shall summon the defendant to appear or, if it thinks fit, may issue a warrant for his arrest in the first instance.

(3) On the appearance of the defendant in pursuance of the summons or warrant, or on his voluntary surrender, the Court shall direct the surety to be discharged from his obligation, and shall call upon the defendant to find fresh security.

Plain English Summary

Enables a surety for appearance to apply at any time to be discharged from his bond, whereupon the court summons or arrests the defendant, releases the surety, and requires fresh security.

Key Legal Elements

  • Unconditional Right of Discharge: Surety has an absolute right to seek discharge at any stage of litigation.
  • Summons or Arrest Warrant: Court may issue a bailable or non-bailable arrest warrant in the first instance to secure defendant's presence.
  • Mandatory Discharge Upon Appearance: Discharge of surety takes effect only when the defendant physically appears or surrenders.
  • Demand for Fresh Security: Defendant must furnish substitute security failing which Rule 4 applies.

Practical Note

Discharge Effective Only Upon Defendant's Production: 1. Timing of Discharge: The surety is not automatically discharged upon merely filing an application under Sub-rule (1). The discharge becomes legally effective only when the defendant appears before the court in person or is arrested and produced under Sub-rule (3). 2. Surety Producing Defendant: A surety can himself bring the defendant to court and surrender him to ensure immediate discharge of the bond.
