Recovery of cost of noting non-acceptance of dishonoured bill or note

Full Text

The holder of every dishonoured bill of exchange or promissory note shall have the same remedies for the recovery of the expenses incurred in noting the same for non-acceptance or non-payment, or otherwise, by reason of such dishonour, as he has under this Order for the recovery of the amount of such bill or note.

Plain English Summary

Entitles the holder of a dishonoured bill of exchange or promissory note to recover notarial noting and protest expenses through the summary procedure alongside the principal face value and interest.

Key Legal Elements

  • Recoverable Outgoings: Expenses of formal noting and protest under Sections 99 and 100 of the Negotiable Instruments Act, 1881.
  • Same Summary Remedy: Notarial expenses are treated as an integral part of the liquidated debt recoverable under Order XXXVII.
  • Direct Inclusion in Plaint: Plaintiff includes notarial charges in the liquidated calculation of the debt without needing a separate action.

Practical Note

Interplay with Negotiable Instruments Act, 1881: 1. Statutory Compensation under Section 117 NI Act: Under Sections 99, 100, and 117 of the Negotiable Instruments Act, 1881, notarial expenses incurred upon dishonour for non-acceptance or non-payment form part of the legal compensation payable to the holder. Rule 6 integrates this statutory entitlement directly into the summary decree. 2. Computation: These expenses should be clearly specified as an itemized liquidated head in the plaint and affidavit under Rule 2 and Rule 3(4).
