Procedure at first hearing
Full Text
(1) At the first hearing the Court may—
(a) declare that the plaintiff is discharged from all liability to the defendants in respect of the thing claimed, award him his costs, and dismiss him from the suit; or
(b) if it thinks that justice or convenience so require, retain all parties until the final disposal of the suit.
(2) Where the Court finds that the admission of the parties or other evidence enable it to do so, it may adjudicate the title to the thing claimed.
(3) Where the admissions of the parties do not enable the Court so to adjudicate, it may direct—
(a) that an issue or issues between the parties be framed and tried, and
(b) that any claimant be made a plaintiff in lieu of or in addition to the original plaintiff,
and shall proceed to try the suit in the ordinary manner.
Plain English Summary
Outlines the procedure at the first hearing: discharging the disinterested stakeholder from liability with costs, adjudicating title on admissions, or converting claimants into opposing plaintiff/defendants to frame issues and try their competing claims in the ordinary manner.
Key Legal Elements
- Exit of the Stakeholder: Sub-rule (1)(a) allows the innocent stakeholder to be discharged with taxable costs at the very threshold of litigation.
- Retention for Justice (Sub-rule 1(b)): Court retains plaintiff only if needed for accounting, identification of goods, or custody verification.
- Immediate Adjudication on Admissions (Sub-rule 2): Summary disposal if competing claims can be resolved on undisputed documentary admissions.
- Conversion of Claimant into Plaintiff (Sub-rule 3(b)): The original plaintiff drops out, and the true contest proceeds between the rival claimants as plaintiff and defendant.
- Issue Framing & Regular Civil Trial: Rival claimants file pleadings against each other, leading to regular trial and decree under Order XX.
Practical Note
Two-Stage Mechanism of Interpleader Trial: 1. First Hearing Stage — Discharge of Plaintiff: Under Sub-rule (1)(a), the court first tests whether the suit is a genuine interpleader. If satisfied that the plaintiff has deposited the res and has no collusion or personal interest, the court discharges the plaintiff, awards him his costs under Rule 6, and dismisses him from the action (Sir Mohammad Yusuf v. Secretary of State, AIR 1921 Bom 17). 2. Second Stage — Contest Between Rival Claimants: Under Sub-rule (3), the action transforms into an ordinary inter se title suit. The court designates one claimant as plaintiff and the other as defendant, frames issues of title or inheritance, and requires them to adduce evidence.
