Recovery of balance due on mortgage in suit for redemption
Full Text
Where the net proceeds of any sale held under rule 8 are found insufficient to pay the amount due to the defendant, the Court, on application by him in execution, may, if the balance is legally recoverable from the plaintiff otherwise than out of the property sold, pass a decree for such balance.
Plain English Summary
Enables the mortgagee-defendant in a redemption suit to obtain a personal deficiency decree in execution against the mortgagor-plaintiff if the sale proceeds of the mortgaged property fail to satisfy the mortgage debt.
Key Legal Elements
- Counterpart to Rule 6: Operates in redemption suits where the mortgagor instituted the action but property had to be auctioned.
- Application in Execution: Mortgagee does not need to file a separate suit; an application in execution suffices.
- Legally Recoverable Prerequisite: Personal covenant to repay must be subsisting and legally enforceable under the law of limitation.
- Net Proceeds Insufficiency: Must establish that net realization from the court auction was inadequate to discharge the decree amount.
Practical Note
Application in Execution Without Separate Plaint: 1. Procedural Efficiency: Rule 8A eliminates the need for the mortgagee to institute an independent money suit. When a mortgagor files a redemption suit, he submits to the jurisdiction of the court for taking accounts. If the mortgaged property is sold and yields a deficit, the mortgagee can directly move the executing court for a personal decree. 2. Caveat on Personal Remedy: The personal covenant must not have been time-barred at the time the redemption suit was instituted. If the mortgagee could not have maintained an independent money claim, no decree under Rule 8A can be granted.
