Section O33R8PopularProcedural

Procedure if application admitted

Full Text

Where the application is granted, it shall be numbered and registered, and shall be deemed the plaint in the suit, and the suit shall proceed in all other respects as a suit instituted in the ordinary manner, except that the plaintiff shall not be liable to pay any court-fee or fees payable for service of process in respect of any petition, appointment of a pleader or other proceeding connected with the suit.

Plain English Summary

Provides that once leave is granted, the application is automatically registered and numbered as a regular suit, deemed to be the plaint from inception, with complete exemption from court fees and process fees throughout the trial.

Key Legal Elements

  • Conversion into Regular Suit: Application converts into regular Civil Suit (e.g. 'O.S. No. 45 of 2026').
  • Deemed Plaint Fiction: Treated as the plaint for all procedural purposes.
  • Total Fee Exemption: No court-fee on petitions, interim applications, vakalatnamas, or summons process fees.

Practical Note

Relation Back to Date of Application: Once admitted under Rule 8, the suit is deemed to have been instituted on the date when the original application under Rule 2 was presented in court. This relation back is critical for limitation purposes; if the application was within time, the suit can never be dismissed on grounds of limitation.
