Grant of time for payment of court-fee
Full Text
Nothing contained in rule 5, rule 7 or rule 15 shall prevent a Court, while rejecting an application under rule 5 or refusing an application under rule 7, from granting time to the applicant to pay the requisite court-fee within such time as may be fixed by the Court or extended by it from time to time; and upon such payment and on payment of the costs referred to in rule 15 within that time, the suit shall be deemed to have been instituted on the date on which the application for permission to sue as an indigent person was presented.
Plain English Summary
Vital protective rule inserted by Act 104 of 1976 empowering the court, upon rejecting or refusing an indigent application, to grant time for payment of court fees, with the landmark consequence that upon payment, the suit relates back to the original presentation date, preventing limitation bars.
Key Legal Elements
- Judicial Power to Grant Time: Court can extend time under Section 148 CPC.
- Doctrine of Relation Back: Suit deemed instituted on original application presentation date.
- Complete Limitation Salvation: Preempts dismissal of suits that would otherwise become time-barred during the pendency of the indigent inquiry.
Practical Note
Saving Limitation Under Rule 15A — Supreme Court Jurisprudence: 1. Crucial Precedent: In Jugal Kishore v. Dhanno Devi (1973) 2 SCC 567 and ML Sethi v. RP Kapur (1972) 2 SCC 427, the Supreme Court held that an application for leave to sue as an indigent person contains a potential plaint. When leave is refused, granting time under Rule 15A preserves the suit from limitation. 2. Courtroom Motion: The moment the Judge indicates that the indigent application is being rejected, immediately make an oral and written prayer: 'Praying for 30 days time under Order XXXIII Rule 15A to deposit the court fees'. Never leave court without an order granting time under Rule 15A.
