Procedure where indigent person’s suit abates

Full Text

Where the suit abates by reason of the death of the plaintiff or of any person added as a co-plaintiff, the Court shall order that the amount of court-fees which would have been paid by the plaintiff if he had not been permitted to sue as an indigent person shall be recoverable by the State Government from the estate of the deceased plaintiff.

Plain English Summary

Inserted by Act 104 of 1976 providing that where an indigent person's suit abates upon their death, the deferred court fees shall be recovered by the State Government from the estate left by the deceased plaintiff.

Key Legal Elements

  • Abatement Trigger: Death of indigent plaintiff without substitution under Order XXII.
  • Liability Restricted to Estate: Recoverable strictly from the estate of the deceased, not from heirs' personal assets.

Practical Note

Protecting Legal Heirs from Personal Liability: When a suit abates on the death of an indigent plaintiff, the State cannot attach the personal salaries or independent properties of the surviving children. Recovery under Rule 11A is strictly confined to the inherited assets left by the deceased plaintiff.
