Retirement of next friend

Full Text

(1) Unless otherwise ordered by the Court, a next friend shall not retire without first procuring a fit person to be put in this place and giving security for the costs already incurred.

(2) The application for the appointment of a new next friend shall be supported by an affidavit showing the fitness of the person proposed and also that he has no interest adverse to that of the minor.

(1) जब तक कि न्यायालय द्वारा अन्यथा आदेश न दिया जाए, कोई भी वाद-मित्र अपने स्थान पर किसी उपयुक्त व्यक्ति को रखे बिना और पहले ही उपगत खर्चों के लिए प्रतिभूति (Security for costs) दिए बिना सेवानिवृत्त (Retire) नहीं होगा।

(2) नए वाद-मित्र की नियुक्ति के लिए आवेदन एक शपथपत्र द्वारा समर्थित होगा जिसमें प्रस्तावित व्यक्ति की उपयुक्तता और यह भी दर्शित किया जाएगा कि उसका अवयस्क के हित के प्रतिकूल कोई हित नहीं है।
