Receipt by next friend or guardian for the suit of property under decree for minor

Full Text

(1) A next friend or guardian for the suit shall not, without the leave of the Court, receive any money or other movable property on behalf of a minor either—

(a) by way of compromise before decree or order, or

(b) under a decree or order in favour of the minor.

(2) Where the next friend or guardian for the suit has not been appointed or declared by competent authority to be guardian of the property of the minor, or, having been so appointed or declared, is under any disability known to the Court to receive the money or other movable property, the Court shall, if it grants him leave to receive the property, require such security and give such directions as will, in its opinion, sufficiently protect the property from waste and ensure its proper application: Provided that the Court may, for reasons to be recorded, dispense with such security while granting leave to the next friend or guardian for the suit to receive money or other movable property under a decree or order, where such next friend or guardian—

(a) is the manager of a Hindu undivided family and the decree or order relates to the property or business of the family; or

(b) is the parent of the minor.

(1) कोई भी वाद-मित्र या वाद के वास्ते संरक्षक, न्यायालय की इजाजत (Leave of the Court) के बिना, अवयस्क की ओर से कोई धन या अन्य जंगम संपत्ति—

(क) डिक्री या आदेश से पूर्व समझौते के रूप में, अथवा

(ख) अवयस्क के पक्ष में किसी डिक्री या आदेश के अधीन,

प्राप्त नहीं करेगा।

(2) जहां वाद-मित्र या संरक्षक सक्षम प्राधिकारी द्वारा अवयस्क की संपत्ति का संरक्षक नियुक्त या घोषित नहीं किया गया है, वहां न्यायालय, यदि उसे संपत्ति प्राप्त करने की इजाजत देता है, तो ऐसी प्रतिभूति (Security) की अपेक्षा करेगा और ऐसे निदेश देगा जो संपत्ति को अपव्यय से बचाने और उसके समुचित उपभोग को सुनिश्चित करने के लिए पर्याप्त हों: परंतु न्यायालय अभिलिखित किए जाने वाले कारणों से ऐसी प्रतिभूति से छूट दे सकेगा जहां ऐसा वाद-मित्र या संरक्षक—

(क) हिंदू अविभक्त कुटुंब (HUF) का प्रबंधक है और डिक्री कुटुंब की संपत्ति या कारबार से संबंधित है; अथवा

(ख) अवयस्क का माता या पिता (Parent) है।
