(1) Nothing contained in this Order shall apply to the Ruler of a foreign State suing or being sued in the name of his State, or being sued by the direction of the Central Government in the name of an agent or in any other name.
(2) Nothing contained in this Order shall be construed as affecting or in any way derogating from the provisions of any local law for the time being in force relating to suits by or against minors or by or against lunatics or other persons of unsound mind.
Plain English Summary
Savings clause exempting foreign rulers suing or sued in their State's name, while preserving the operation of state and local enactments governing litigation by or against minors and mentally disabled persons.
Key Legal Elements
- Foreign Sovereign Exemption (Sub-rule 1): Sovereign immunity principles under Section 86 CPC.
- Preservation of Local Acts (Sub-rule 2): Local laws (e.g. Court of Wards Acts, State Guardian laws) prevail over general CPC provisions.
Practical Note
Interplay with Court of Wards Legislation: Under sub-rule (2), where an estate is under the superintendence of the Court of Wards under a State enactment (e.g., UP Court of Wards Act), the special provisions of that local statute regarding representation take precedence over Order XXXII.
