Explanation.—For the avoidance of doubts, it is hereby declared that the provisions of rule 6 shall be without any prejudice to the concept of "family" in any personal law or in another law for the time being in force.
Plain English Summary
Provides an expansive, inclusive statutory definition of 'family' encompassing cohabiting spouses, biological or maintained children, single parents, siblings, ancestors, and co-residing lineal descendants, preserving personal law concepts via the Explanation.
Key Legal Elements
- Comprehensive Categories: Nuclear families, single-parent households, blended families, joint households.
- Maintenance Nexus: Includes any children maintained by the household, not strictly biological.
- Collateral & Ancestral Inclusions: Brothers, sisters, parents, grandparents living together.
- Personal Law Harmony (Explanation): Does not alter definitions of joint Hindu family or coparcenary under personal laws.
Practical Note
Broad Locus in Domestic & Property Injunctions: Because Rule 6 defines 'family' to include single mothers, brothers, sisters, and grandparents living together, suits for residence, protection from domestic disturbance, or succession among co-residing family members fall squarely within Order XXXII-A, entitling parties to seek in-camera hearings and court-directed mediation.
