Proceedings to be held in camera

Full Text

In every suit or proceeding to which this Order applies, the proceedings may be held in camera if the Court so desires and shall be so held if either party so desires.

Plain English Summary

Guarantees in-camera (confidential, closed-door) hearings in all family and matrimonial disputes, making in-camera proceedings mandatory upon the request of either party to safeguard privacy and dignity.

Key Legal Elements

  • Judicial Discretion: Court may initiate in-camera proceedings suo motu.
  • Mandatory on Party Request: Use of 'shall be so held if either party so desires' confers an absolute statutory right on either litigant.
  • Protection of Privacy: Excludes public and media from sensitive matrimonial, paternity, and custody proceedings.

Practical Note

Enforcing Right to In-Camera Trial: Where sensitive allegations of cruelty, adultery, impotence, or paternity are pleaded, counsel for either spouse should file an application under Rule 2 praying for in-camera trial. The judge has no discretion to refuse; upon a party's request, holding the trial in-camera is a mandatory statutory obligation.
