Frame of suit

Full Text

Every suit shall as far as practicable be framed so as to afford ground for final decision upon the subjects in dispute and to prevent further litigation concerning them.

Plain English Summary

Lays down the foundational maxim that civil suits must be comprehensively structured to enable a conclusive and final adjudication of all disputes between the parties and prevent multiplicity of proceedings.

Key Legal Elements

  • Cardinal Principle: Comprehensive framing of suit to achieve finality of litigation (Interest reipublicae ut sit finis litium).
  • Prevention of Multiplicity: Discourages piecemeal, fragmented, or split litigation arising from the same controversy.
  • Statutory Objective: Operates as the governing preamble to the strict bars contained in Rule 2.

Practical Note

Litigation Strategy & Drafting Principles: 1. Holism in Plaint Drafting: Rule 1 mandates that a plaintiff must not institute truncated proceedings leaving vital aspects open. All ancillary reliefs—such as possession, mesne profits, declarations, and permanent injunctions—arising from the disputed transaction should be encompassed. 2. Defense Utility: Where a plaintiff institutes a series of vexatious suits for narrow grievances, defendant's counsel can cite Rule 1 read with Rule 2 to argue abuse of judicial process. 3. Interplay with Res Judicata: Rule 1 embodies the legislative policy underlying constructive res judicata (Section 11 Explanation IV).
