Service on person so authorised, or on his pleader, to be good service
Full Text
Processes served upon any person authorised by an officer, soldier, sailor or airman under rule 1 or upon any pleader appointed as aforesaid by such person shall be as effectual as if they had been served on the party in person.
Plain English Summary
Deems service of court processes, notices, and summonses upon the soldier's authorized representative or appointed pleader as legally equivalent to direct personal service on the military personnel.
Key Legal Elements
- Equivalence of Service: Service on agent or pleader equals personal service on the serviceman.
- All Processes Included: Summons, notices, interim injunctions, execution notices.
- Prevention of Ex-Parte Defaults: Ensures legal continuity and prevents ex-parte orders due to field deployment.
Practical Note
Managing Court Process During Deployments: Once an authority under Rule 1 is placed on record and an advocate is engaged under Rule 2, the adversary cannot seek ex-parte decrees claiming the soldier could not be served in the cantonment or border unit. All notices must be served on the on-record advocate.
