Costs

Full Text

Where, under rule 2 or rule 2A the Government or any other authority is added as a defendant in a suit, the Attorney-General, Advocate-General, or Government Pleader or Government or other authority shall not be entitled to, or liable for, costs in the Court which ordered the addition unless the Court, having regard to all the circumstances of the case for any special reason, otherwise orders.

Plain English Summary

Immunizes the Government, statutory authorities, and Law Officers added under Rules 2 and 2A from liability for costs or entitlement to costs, except where the court expressly directs otherwise for recorded special reasons.

Key Legal Elements

  • Cost Immunity: No entitlement to costs and no liability to pay costs.
  • Entities Covered: Attorney-General, Advocate-General, Government Pleader, Government, and statutory authorities.
  • Judicial Exception: Court may award costs only by recording explicit 'special reasons'.
  • Public Policy Rationale: Protects public authorities intervening solely to clarify questions of law from vexatious cost burdens.

Practical Note

Resisting Cost Orders Against Intervening Authorities: If the trial court, after invalidating an ambiguous government circular, imposes heavy compensatory costs on the impleaded Government or statutory board, cite Rule 3 in appeal or review. The general statutory rule prohibits awarding costs against a statutory intervenor unless an exceptional finding of mala fides is recorded with special reasons.
