Where witness resides within Court’s jurisdiction

Full Text

A commission for the examination of a person who resides within the local limits of the jurisdiction of the Court issuing the same may be issued to any person whom the Court thinks fit to execute it.

Plain English Summary

Grants broad judicial discretion to appoint any suitable person (typically a practicing junior advocate or court official) as commissioner to examine an intra-jurisdictional witness.

Key Legal Elements

  • Appointee Discretion: Court may appoint any person it deems fit (traditionally an Advocate Commissioner).
  • Neutrality Requirement: Appointee must be impartial and unconnected with the litigants.
  • Local Territorial Nexus: Applicable when the witness resides within the territorial boundary of the trial court.

Practical Note

Selection of Advocate Commissioner: Counsel should ensure that the person appointed is a neutral, practicing member of the bar with no conflict of interest with either party. Parties may jointly suggest names or leave it to the roster maintained by the District Judge.
