Expenses of commission to be paid into court
Full Text
Before issuing any commission under this Order, the Court may order such sum (if any) as it thinks reasonable for the expenses of the commission to be, within a time to be fixed, paid into Court by the party at whose instance or for whose benefit the commission is issued.
Plain English Summary
Requires the party applying for or benefiting from a commission to deposit advance remuneration, travel expenses, and processing fees into court before the commission writ is issued.
Key Legal Elements
- Pre-Condition of Deposit: Expenses must be deposited before issuance of the commission writ.
- Quantum Discretion: Court determines reasonable fee taking into account nature, complexity, and distance.
- Cost Allocation: Initial deposit by applicant party, ultimate liability determined at final judgment as costs in the suit.
Practical Note
Default in Depositing Commissioner Fee: If the party seeking the commission fails to deposit the assessed fee within the time fixed by the court, the adversary should pray for recall of the commission order and closure of that stage. The court will not keep the suit stalled indefinitely.
